This is a legal agreement between you (“User”) and CarEye Alliance (“we” or “us” or “CarEye
Alliance”) regarding the use of the CarEye Alliance App (“App”). (“App”).
1.
Definitions
App: refers to CarEye Alliance App, including but not limited to its software,
updates, patches, plug-ins and so on.
User: means an individual or organization using the
App.
Service: refers to the functions and services we provide through the App, including but not
limited to vehicle monitoring, location tracking, driving behavior analysis, etc.
2. Entry
into force of the Agreement
This Agreement shall take effect from the date of the User's first
use of the App.
By using the App, the User agrees to accept all the terms and conditions of this
Agreement.
3. Services
We provide the following services through the App:
Vehicle
Monitoring: Provide vehicle location, speed, direction and other information.
Location Tracking:
Provide vehicle history track information.
Driving Behavior Analysis: Provide analysis and
evaluation of driver's driving behavior.
We reserve the right to modify or terminate the service
at any time.
4. User Obligations
Users must comply with this Agreement and relevant laws
and regulations.
Users must not use the App for any illegal, immoral or infringement of others'
rights and interests.
Users must protect their accounts and passwords and must not disclose them
to others.
Users must ensure that their vehicle information is accurate, complete and
up-to-date.
5. Intellectual Property Rights
The ownership, intellectual property rights
and other related rights of the App belong to us.
Users may not copy, modify, distribute, sell or
otherwise use any part of the App.
6. Privacy
We will protect users' personal information
and privacy.
We will collect, use and protect users' personal information in accordance with
relevant laws and regulations and this Agreement.
We will use encryption technology and other
security measures to protect users' data.
7. Disclaimer
We do not guarantee that the App's
services will be uninterrupted, error-free or virus-free.
We are not responsible for any damage
or loss caused by the User's use of the App.
We are not responsible for the safety of the User's
vehicle or the driving behavior of the driver.
8. Modifications to the Agreement
We
reserve the right to modify the Agreement at any time.
The modified Agreement will be posted on
the App, and the User's continued use of the App constitutes acceptance of the modified
Agreement.
9. Dispute Resolution
The laws of the People's Republic of China shall apply to
the interpretation, implementation and dispute resolution of this Agreement.
Any dispute or
controversy shall be resolved through friendly negotiation; if the negotiation fails, a lawsuit may
be filed with [name of court].
10. Others
The headings of this Agreement are for
convenience of reading only and shall not affect the interpretation of this Agreement.
Any
provision of this Agreement held to be invalid or unenforceable shall not affect the validity of
other provisions.
